Passaic's zoning schedule of regulations (amended April 29, 2014) allows one one-family dwelling per lot in the R-1 district, with a minimum lot of 5,000 square feet, 50 feet wide and 100 feet deep, a 35-foot height limit and 30% maximum lot coverage.

The city's 2024 Re-examination Report of the Master Plan, adopted by the Planning Board on December 4, 2024, says Passaic has little vacant land available for development and that most development activity will come through redevelopment.

Buildable land in the City of Passaic is scarce: the city's own planners describe little vacant land, and close to a quarter of it lies in a mapped flood hazard area near the river. A new house here usually goes on a single lot of around 5,000 square feet, which suits a narrow two-storey plan with a metal or board-and-batten exterior better than a wide shop building. The house must meet the Uniform Construction Code, whose one- and two-family rules have followed the 2024 International Residential Code, New Jersey edition, since August 17, 2026. Licensed trade contractors handle plumbing, electrical and HVAC and submit their own technical sections.
